Fani Willis Asks Court to Reinstate Charges Against Trump Associates

(DailyVantage.com) – Fulton County District Attorney Fani Willis has asked the Georgia Court of Appeals to reinstate six charges against former President Donald Trump and his co-defendants related to the 2020 election case. This request follows a decision by Fulton County Judge Scott McAfee earlier this year to dismiss the charges due to insufficient detail in the allegations. In her filing, Willis argued that the indictment provided ample context and facts, allowing the defendants to prepare a defense. She is urging the appeals court to reverse McAfee’s decision and reinstate counts 2, 5, 6, 28, 36, and 38 of the indictment.

The case has faced multiple setbacks, including further dismissals of charges by McAfee last month, where he ruled that Willis lacked the authority to bring charges related to alleged false document filings in federal court. However, McAfee upheld the racketeering charge against Trump and his co-defendants.

Adding further complications, the case was paused by the Georgia Court of Appeals in June to consider Trump’s argument for disqualifying Willis due to an alleged improper relationship between her and Nathan Wade, a prosecutor involved in the case. The court is scheduled to hear Trump’s disqualification argument in December, after the 2024 election.

Trump’s legal team, led by attorney Steve Sadow, disputes Willis’ appeal, asserting that the trial court was correct in dismissing the charges for insufficient pleading under Georgia law. Trump has pleaded not guilty to all charges in the case.
