(DailyVantage.com) – Pastor Michael Jennings was across the street from his home watering his neighbor’s flowers while they were away when police showed up on May 22. What happened next turned into a long ordeal for both sides. Now, the pastor is considering taking legal action based on the department’s conduct that day.

The situation unfolded as Jennings was supposedly helping a neighbor out, and someone called the police to report suspicious activity at the house. When the Childersburg Police Department officers arrived, he greeted them and introduced himself. When he failed to show identification — which police can request by law if they suspect a person “is committing, has committed or is about to commit a felony or other public offense” — they placed him in handcuffs in the back of a police cruiser.

Jennings’ attorney, Harry Daniels, argued that the pastor wasn’t in a public place and, therefore, that law didn’t apply. A municipal judge agreed when they dropped the charges against him in June.

The body cam footage shows Jennings in handcuffs, with the police lecturing him on showing identification. The officer claims he didn’t identify himself, and the pastor was adamant he did. According to Daniels, the officer in charge “tried to rewrite history” to justify Jennings’ arrest.

Jennings is considering filing a lawsuit against the police department for racial discrimination.
